The U.S. Trade Representative announced on August 6, 2020 that effective with respect to goods entered, or withdrawn from warehouse for consumption, on or after 12:01 AM EST on August 7, 2020, he would extend only 266 of the product exclusions previously granted to certain goods covered by List # 3 until 11:59 PM EST on December 31, 2020 (access the USTR’s notice here). The remainder, or 725 product exclusions covered by Harmonized Tariff Schedule Numbers (HTS#) 9903.88.13, 9903.88.18, 9903.88.33, 9903.88.34, 9903.88.35, 9903.88.36, 9903.88.37, 9903.88.38, 9903.88.40, 9903.88.41, 9903.88.43, 9903.88.45, 9903.88.46 and 9903.88.48 have expired as of August 7, 2020.
The extended product exclusions must be reported on the Customs entry under subheading 9903.88.56.
The classifications affected are included in the 2020 Harmonized Tariff Schedule of the United States (“HTSUS”), Chapter 99, Sub-Chapter III, U.S. Notes 20(p), (w), (ll), (mm), (nn), (oo), (pp), (qq), (ss), (tt), (vv), (xx), (yy) and (aaa), pages 185 to 388 of Revision 18, from page 185 to 388 (access the HTSUS here). Please be aware that the HTSUS has not been updated to reflect the changes for HTS#9903.88.56 yet.
